These Terms and Conditions of Service (“Terms”) apply to your use of the websites, mobile applications and services (collectively, the “Services”) provided by Avesta Co., Ltd.

1. General Terms
   1.1 These Terms and Conditions of Use (“Terms”) govern your use of the websites, mobile applications and services (collectively, the “Services”) provided by Avesta Co., Ltd.
   1.2 The Company reserves the right to update or modify this Agreement without prior notice. Your continued use of the System shall constitute your acceptance of the updated Terms. EAUCTION.CLUB will notify you of such changes by reasonable means, including by posting the revised Terms on this Website.
2. Eligibility to Accept Terms
   2.1 When you confirm that you are over 18 years of age, or have obtained legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations and warranties set out in these Terms and to comply with these Terms.
3. Access to the Services
   3.1 You are responsible for all access to the EAUCTION.CLUB Services made through your Internet connection, even if accessed by another person.
   3.2 EAUCTION.CLUB will use reasonable efforts to make the Services available at all times. However, EAUCTION.CLUB cannot guarantee that the Services or any function or feature of the Services will always be available and/or error-free, and our Services may be unavailable during periods when we are conducting necessary updates or maintenance.
4. Account Registration and Use
   4.1 Users must register for an account and provide accurate and complete information.
   4.2 Users are responsible for maintaining the security of their account information and password.
5. Accessing EAUCTION.CLUB services from abroad
   • EAUCTION.CLUB makes no representation that the contents of the EAUCTION.CLUB Service are appropriate or available for use in locations outside of Thailand. Accessing the Service from a location where the contents or services of EAUCTION.CLUB are not legal in such location is illegal or unlawful. If you access the EAUCTION.CLUB Service from other locations, you do so at your own risk. You are responsible for complying with and being liable for any such actions in accordance with the local laws of such locations.
6. Use of services
   
   • The license granted to you to use the Services is personal and non-transferable. In using the EAUCTION.CLUB Services, you must comply with the terms set forth in these Terms and you agree not to:
     6.1 Use the Services for fraudulent or illegal purposes.
     6.2 Use the Services in a manner that would defame, abuse, harass, stalk, threaten, intimidate or infringe the rights of others, including but not limited to their privacy or publicity rights.
     6.3 Impersonate any person or entity, falsely state or otherwise misrepresent your affiliation with any person or entity associated with the Site, or express or imply that EAUCTION.CLUB endorses any of your statements.
     6.4 Interfere with or disrupt the operation of the Services, or servers or networks used to provide the EAUCTION.CLUB Services, or violate any requirements, procedures, policies or regulations of such networks.
     6.5 Transmit or otherwise transmit any viruses, worms or other computer code that is harmful or invasive, or intended to damage the operation of the Services; Or to monitor the use of any hardware, software or device.
     6.6 Reproduce, duplicate, copy, sell, resell or exploit for commercial purposes any portion of, use of or access to the Services.
     6.7 Modify, adapt, translate, reverse engineer, decompile or disassemble any part of the Services.
     6.8 Remove any copyright, trademark or other proprietary notices from the Services or materials and documentation available from our Services.
     6.9 Display or reflect any part of our Services without our prior written consent.
     6.10 Create a database by systematically downloading and storing details of the Services.
     6.11 Use any manual or automatic device to store data or content on the Services or reproduce or circumvent the navigation system on the Site or the Service offering without EAUCTION.CLUB’s express prior written consent. However, EAUCTION.CLUB grants public online search engine providers permission to use their retrieval applications to reproduce materials from the Services for the purposes necessary for creating publicly accessible indexes of such materials through their respective online search services.
   • We reserve the right to revoke these exceptions in general or in specific cases.
7. Third Party Websites
   7.1 The EAUCTION.CLUB Services may contain links to other websites and online resources. However, EAUCTION.CLUB is not responsible for and does not endorse such external websites or resources. Use of such third-party websites and resources is at your own risk.
   7.2 You may create a link to the EAUCTION.CLUB Services, provided that:
   7.3 The link is appropriate and legal and does not mislead or imply any affiliation, approval or endorsement of EAUCTION.CLUB that does not exist or that would harm the reputation of EAUCTION.CLUB or its affiliates. You have the legal right to remove a link immediately upon request of EAUCTION.CLUB.
   
   • We reserve the right to request that you immediately remove any link to the EAUCTION.CLUB service, and you must comply with such request.
8. Intellectual property
   • • The intellectual property rights in the Service and all text, images, videos, graphics, user interfaces, visual interfaces, trademarks, logos, applications, programs, computer code and other content are owned by EAUCTION.CLUB and its licensors. You may not print or copy such content without prior permission from EAUCTION.CLUB.
9. Bidding Participation and Deposit
   9.1 Each auction entry requires a deposit of 10 Coins per auction.
   9.2 The system will automatically deduct Coins for the deposit when you enter the auction.
   9.3 Coins used for the deposit are non-refundable, except in cases where the auction is canceled by the system.
10. Credit System (Coin)
    10.1 Users must top up a minimum of 100 Coins before participating in the auction.
    10.2 Coins are non-refundable.
    10.3 Coins are used for:
    – Auction deposits
    – System service fee at the rate of 2.5% of the product value for successful auctions.
11. Payments and Negative Balance Policy
    11.1 When an auction ends, a 2.5% service fee will be automatically deducted from the account.
    11.2 If the account balance becomes negative (i.e. there are not enough Coins to pay the service fee):
    – The user must top up Coins to reach a positive balance within 30 days
    – Failure to do so will result in the account being suspended.
12. Account Suspension and Activation
    An account will be suspended if:
    12.1 the outstanding balance is not paid within 30 days
    12.2 the account is used for misuse or violates the rules of the system. The account will be able to be used again after being suspended by
    12.3 paying the outstanding balance in full
    12.4 submitting a request to reactivate the account.
13. Cancellation and Refund Policy
    13.1 Users may cancel their bidding before the auction ends, but the coins used as a deposit are non-refundable.
    13.2 In the event that the auction is canceled by the system, the coins used as a deposit will be refunded to the user.
14. User Responsibilities
    14.1 User must ensure that they have sufficient Coins before participating in the auction.
    14.2 User must pay any outstanding balance on time.
15. Limitation of Liability
    15.1 EAUCTION.CLUB provides the Services “as is” and makes no representations as to the quality, completeness or accuracy of any content contained on our Services. To the fullest extent permitted by law, our liability excludes
    15.2 all conditions, warranties and other terms that may be otherwise provided by law in connection with these Terms and any of your liabilities, whether arising under these Terms or in connection with your use of the Services.
    15.3 The foregoing is a comprehensive limitation of liability that applies to all types of damages, including but not limited to compensatory, direct, indirect or consequential damages, loss of data, loss of income or profits, loss or damage to property and claims of third parties. Notwithstanding the foregoing, nothing in these Terms is intended to exclude or limit any liability that may not be excluded or limited by law, and in particular, none of the exclusions and limitations in this Section are intended to limit any rights you may have as a consumer under Thai law or statutory rights that may not be excluded, or to exclude or limit in any way EAUCTION.CLUB’s liability to you for death or personal injury. As a result of the negligence of EAUCTION.CLUB or of its employees or agents.
16. Collection of personal data
    
    • EAUCTION.CLUB may collect and use information relating to you in accordance with EAUCTION.CLUB’s Privacy Policy, a copy of which can be viewed at https://eauction.club/privacy-policy/
17. Duration of the provision
    
    • These Terms are effective until terminated, and EAUCTION.CLUB may terminate your access to or use of the Services at any time and for any reason. If EAUCTION.CLUB terminates your access to the Services, you will have no right to dispute with EAUCTION.CLUB or its affiliates in respect of such termination, and EAUCTION.CLUB and its affiliates will not be liable for any termination of your access to the Services.
18. Applicable Law
    
    • These Terms and Conditions of Use shall be governed by and construed in accordance with the laws of Thailand and any claim or dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Thailand having general jurisdiction.
